MEREDAM WACANA PEMBENTUKAN PENGADILAN NIAGA SYARI’AH

Abstract

An Islamic economic development in Indonesia has been transformed into the biggest Islamic retail banking in the world. Consequently, the Religious Court as the only court competent to hear disputes of syari’ah economy is challenged to overcome any exiting of disputes. However, it seems which the implementation of the assignment is not as smooth as the fairy story. Every criticism has not been believed rampant disturst incresingly.  The culmination, point was born the idea of the establishment of the Commercial Court of Syari’ah, as the peak of distrust in Religious Courts. The issue is what should be answered clearly by the future of an Islamic economic, Religious Court, as well as nation constitutional.
